INDIANA SECRETARY OF STATE TURNS OVER EVIDENCE OF ACORN FRAUD TO THE FBI

Indiana Secretary of State Todd Rokita submitted 100 hours worth of investigative work to the FBI and prosecutors requesting an investigation of the voter advocacy group ACORN.

Indiana Attorney General Steve Carter confirms there have been allegations of voter registration fraud in Lake County.

Rokita said 1,400 application submitted by ACORN violated Indiana election laws.

Long lines inside the County-City building are indicative of the growing popularity of early voting across the state, including Lake County, where hour-long waits are the norm.

Across the nation, the number of early voters has surged, and so have the problems.

"There have been a number of allegations about fraud in the registration process," said Carter.

Rokita has requested a criminal investigation in Lake County. He determined from 1,438 applications submitted by ACORN:

# 61 percent showed one or more indications of fraud or forgery
# 54 percent had no verifiable information
# 30 percent featured incorrect, incomplete or illegible information

"Unfortunately, Lake County has a history of vote fraud," said Carter. "It's very important that we have elections that are full of integrity and people believe that it's a fair process."

Rokita said despite claims from ACORN that it brought this matter to the attention of election officials, he indicated, "Clearly, ACORN representatives continued to submit applications they knew to be fraudulent to voter registration officials."

DOG AND GOLDFISH REGISTERED TO VOTE IN LAKE COUNTY, INDIANA

The headline of this article was "Possible voter registration fraud problems". "Possible"? Really? Ya think? More revealing news from Lake County, Indiana.

Local authorities say they have discovered discrepancies in hundreds of motor voter registrations. They say, in one case, someone registered a dog to vote.

"Campaigns and candidates need to realize that things can be wrong. We can't say with assurance that all the people in our voter rolls are valid residents at the address where they are registered," said Lake County Clerk Willard Helander.

Helander wants to get on the record before Election Day. She says there has been an unprecedented number of problems with the mail-in voter registration cards. The clerk also says registering by mail is based on an honors system, a system that has been breached in Lake County.

The clerk says she has seen various problems. For example, deceased voters have been revived. Residents who are not even eligible to vote have received cards. On one card, a person wrote, "cannot vote - not a US citizen." Another card had a voter named Princess. It turns out, 'Princess' is not only dead, but Princess was a goldfish. When asked about race or ethnic group, another person wrote canine. And these are the cards that were caught. The clerk is worried about the ones that weren't.

This is one of the most incredible stories I've seen in some time. It's completely under the radar, but this is so reminiscent of Nazi Germany it's scary.

St. Louis and Missouri law enforcement are planning to go after anyone who makes false statements against Obama during his campaign.

St. Louis City Circuit Attorney Jennifer Joyce and St. Louis County Circuit Attorney Bob McCulloch are threatening to bring libel charges against those who speak out falsely against Barack Obama.

KMOV aired a story last night, that stated that St. Louis County Circuit Attorney Bob McCulloch and St. Louis City Circuit Attorney Jennifer Joyce, both Obama supporters, are threatening to bring criminal libel charges against anyone who levels what turns out to be false criticisms of their chosen candidate for President.

KMOV Channel 4’s TV newscast night before last at 6 PM had a story, that stated that St. Louis County Circuit Attorney Bob McCulloch and St. Louis City Circuit Attorney Jennifer Joyce, both Obama supporters, are implying that they will bring criminal libel charges against anyone who levels what turns out to be false criticisms of their chosen candidate for President.

In 1964, the U.S. Supreme Court issued a landmark decision, New York Times vs Sullivan, that set the benchmark for libel vis-a-vis “public figures,” of which Barack Obama is certainly one. If a public figure brings a civil libel lawsuit against an individual or a group, then s/he has to prove to a civil jury (usually nine out of twelve jurors) that a preponderance of the evidence (i.e. it is more likely than not) shows that the defendant(s) knowingly said or wrote something factually incorrect about the plaintiff(s). If a prosecutorial authority brings criminal libel charges against a defendant on behalf of a plaintiff, as McCulloch and Joyce are threatening to do, then the prosecutor has to prove beyond a reasonable doubt to twelve out of twelve jurors that the defendant knowingly said or wrote something factually incorrect about the defendant.

The two key concepts here are “knowingly” and “factual.” Successful civil libel lawsuits brought by public figures are exceedingly rare, because it’s very difficult to prove that the defendant “knowingly” said or wrote something factually incorrect. Criminal libel prosecutions thereof, because they require a unanimous jury and a higher legal standard of proof, are virtually impossible.

As for “factual,” it means that the statement made cannot relate to an opinion. If you say that Barack Obama isn’t really a Christian, that’s not a statement of fact, because religion is mostly subjective. The Catholic Church still really doesn’t consider Protestants to be Christians, and in some cases, some radical Protestants don’t think that Catholics are really Christians. Therefore, if one says that Barack Obama isn’t a Christian, it isn’t actionable, because it’s somebody’s opinion. Now, if Obama were a Catholic, and really was Confirmed as such, and someone for whom that it can be proven does know he is a Confirmed Catholic goes out and says that he isn’t, that’s actionable. The reason is that Confirmation in the Catholic Church is (usually) provable by ecclesiastical records.

In other words, virtually nobody that levels criticism at Barack Obama can be charged criminally for doing so.

However, in the opinion of this writer, Bob McCulloch and Jennifer Joyce are, at the behest of the Obama campaign, ratting sabers to intimidate people from criticizing Obama. If my contention is correct, then if anyone will face civil or maybe criminal liability from the U.S. Justice Department, the U.S. Attorney’s Office in St. Louis, it’s McCulloch and Joyce themselves. It is not beyond the realm of possibility, in my opinion, that their threats violated Federal Civil Rights laws, two public authorities might well be forcing a “chilling effect” on 1st Amendent free speech. If Barack Obama or any of his people have any fingerprints on this, they could be sent up the river as well.

I think this blogger has nailed it. This, in my opinion, is nothing other than some high level Obama supporters trying to intimidate any dissenters of Obama into silence. It certainly fits the new Obama model as evidenced by his recent attempts to silence the NRA in Pennsylvania and Ohio:

The Obama campaign has written radio stations in Pennsylvania and Ohio, pressing them to refuse to air an ad from the National Rifle Association.

"This advertisement knowingly misleads your viewing audience about Senator Obama's position on the Second Amendment," says the letter from Obama general counsel Bob Bauer. "For the sake of both FCC licensing requirements and the public interest, your station should refuse to continue to air this advertisement."

NRA spokesman Andrew Arulanandam, who provided the letter, said it shows clear evidence that the ads are "hurting him," and stood by their substance. He also provided a copy of the NRA's own letter to the stations and memo disputing the Post story, after the jump. He also said the ad is running only in Pennsylvania at the moment.

It also is consistent with Obama's truth squads that were dispatched during the primary against Hillary Clinton in South Carolina. Obama has also dispatched his "truth squad" goons in Pennsylvania, Indiana, California, and North Carolina.

OBAMA GETS HOODWINKED AND BAMBOOZLED OVER BREAKFAST TAB

If Canadians can do this to him, just imagine what's going to happen when he sits down to talk with terrorists and dictators.

The Democratic presidential hopeful was trolling the Four Seasons Family Restaurant in Greenwood, Ind., early Tuesday morning looking to lock up some last-minute votes.

Diner Steve Czajkowski, a pastor at the Community Church in town, held out his breakfast bill. "Take this [and] we'll seal the deal," he quipped.

Obama quickly snatched Czajkowski's tab. "I've got your check," he declared.

Czajkowski tried to grab the bill back, explaining to Obama that he was only joking. But Obama insisted on paying and walked off with the $25 bill firmly in hand.

"I like his message. I like the way he's running his campaign," Czajkowski told reporters.

But Obama didn't get his vote. "I'm Canadian," he said.

OBAMA LECTURES ON PARENTAL RESPONSIBILITY - IS THIS GUY KIDDING ME?

The audacity of this guy. To lecture anyone on raising kids when his children have spent their entire lives worshipping at a church whose pastor teaches a religion that holds that God hates white people. "That's some home training". Oh. Obama. I loves it when you keeps it real.

The standard Barack Obama venue lately has been high schools. Truman High School, Theodore Roosevelt High School, Jefferson High School.

The Democratic presidential candidate has been pitching an audience-pleasing message of economic populism to crowds of a few thousand packed into each gymnasium. But he gets some of his loudest applause when he segues to education - and a bit of a lecture to mothers and fathers on how to be parents.

Sure, there is the usual critique of current government policies. But the cheering peaks with a dose of tough talk.

"Parents if you don't parent, we can't improve our schools," he said. "You've got to parent. You've got to turn off the television set in your house once in a while, you've got to put the video game away once in a while."

"You should have a curfew in your house so your children aren't out in the streets all night. You should meet with the teacher and find out what the homework is and help that child with the homework. And if you don't know how to do the homework, don't be embarrassed, find someone to help you."

"Fathers, be fathers," he added. "Be a part of your child's life. Be a part of your child's life and try to make them proud.

"And the last thing is, if your child is misbehaving at school don't curse out the teacher. You know who you are. It's not the teacher's fault that your child is misbehaving. That's some home training."

Of course, the crowd applauded wildly. Those parents in the crowd would have been doing the responsible thing all along. It's just that no one told them they needed to be responsible parents. So, you know, they weren't. Well Obama has told them like it "T.I. is". So, those parents are good now. Problem solved. Thank you Obama.
